TOS violation = crime

Was not sure were to put so i put here.
On Thursday, the U.S. Attorney for the Central District of California announced that Lori Drew, now 49 years old, was indicted on conspiracy and hacking charges. The indictment charges Drew, a resident of O'Fallon, Missouri, with three counts of unauthorized access by violation of MySpace's terms of service and one count of conspiracy.

Not sure what everyone else will think. In the US a women was sent to jail over violating myspaces tos. There is more to it. some links

Only because I think someone couldn't understand that bullying in the internet has nothing to do with real life. Yes, even when the bully might destroy your "reputation". According to that story the girl had been diagnosed for few things like depression and was eating 3 different antidepressant so her self image and confidence was already down. Sucked to be her.

Of course the mother was a retard too, I'm not saying that, but the internet bullies often are horribly stupid.

However, is it possible to fully ban someone from your website?

UserID Ban = Creates a new account
Email Ban = Creates a new email account. IE. Make a quick hotmail account.
IP Ban = Banned until ISP assigns new IP to their line. Or is Dialup its until they re-connected.
Complete banned at isp (isp stops user going to website) = Is this even possible? If so, they could always use a wireless connection at a neighbours wifi connection, or a local internet cafe, even at a local library.

So is it really possible?

The website she was using was myspace... and I'd guess the average myspace user wouldn't have a clue how to get around a simple ban :)

How can they do that?  What are your thoughts on it? I think they are talking about Opera's built in auto refresher (not 100% on that)   Firefox offer a crap load of ad-ons  that could grant  advantage over IE.

Well, i am guessing only a minor percentage of users use opera, however that is still people that they are not allowing to play their game.

Ok, I'll finally weigh in here.

On Violate TOS = Hacking:
This is a HORRIBLE precedent to be set. Yet another way to limit your rights. If this is the case, I believe it should now be expressly stated in the site's TOS what the MAXIMUM PENALTY for their violation is.

On the 'Evil Mom' & suicide 'victim':
The case doesn't sound like it was about TOS Violation to me, it sound to me like we have to deal with a new law because someone died. This did NOT arise because of TOS violation, the root cause was harassment. The girl did NOT die because the Mom falsified her information, she died because she chose that as the means to end her harassment.

Now, I agree that the Mom was juvenile and should not have done what she did. However, the little girl was just as stupid, probably MORE so, than the Mom. At least the Mom is still alive. All it really would have taken was showing the harassing communication to her family and the harassment would have ended one way or another. Ending your life is not exactly an optimal method of solving a problem in your life ;) However, I must say that I am a big fan of stupid people removing themselves from the gene pool.

Yes, I know, I'm heartless. But the girl must have been as well as she chose to end her life and place the burden of that kind of hurt on everyone who cared about her. If I can survive every day after holding my first-born child while she struggled for breath in my arms until she stopped breathing (she had Anencephaly) , certainly, this girl could have withstood a little bit of hurt feelings.
